These Terms of Service ("Terms") govern your access to and use of ForgeBody ("Service"), operated by ForgeBody ("we", "us", "our"). By signing up or using the Service, you agree to these Terms in full.

1. Service Description

ForgeBody provides AI-powered weight loss coaching delivered via WhatsApp. The Service includes:

• Personalized daily check-in messages via WhatsApp
• AI coaching responses to your messages (meal advice, motivation, accountability)
• Optional food photo analysis via WhatsApp image
• Progress tracking through conversation

The AI coach is powered by Claude (Anthropic). Responses are generated automatically and are not reviewed by human coaches or medical professionals.

2. Eligibility

To use ForgeBody you must:

• Be at least 18 years old
• Reside in the United Kingdom or the Republic of Ireland
• Have a valid UK or Irish mobile number with WhatsApp installed
• Provide accurate information during signup

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Subscription & Billing

ForgeBody offers the following plans:

• 7-Day Trial: €1 one-time payment. Full access for 7 days. Automatically converts to Monthly Founding rate (€39/month) unless cancelled before day 7.
• Monthly (Founding Member): €39/month. Billed monthly. Cancel anytime. Price locked for life.
• Monthly (Regular): €59/month. Billed monthly. Cancel anytime.

Payments are processed by Lemon Squeezy (Merchant of Record). Lemon Squeezy handles UK VAT (20%) and Irish VAT (23%) automatically. By subscribing, you authorise Lemon Squeezy to charge your payment method on a recurring basis. You can manage or cancel your subscription at any time via our contact form.

4. Refund Policy & Right of Withdrawal

• 7-Day Trial (€1): Non-refundable.
• Monthly (€39/mo Founding or €59/mo Regular): 3-day refund window from first charge. Cancel before next billing cycle to avoid future charges.
• UK consumers (Consumer Contracts Regulations 2013): You have a 14-day statutory right of withdrawal from the date of purchase. By signing up you expressly consent to immediate commencement of the digital service. You acknowledge that once the service has commenced, you lose the right of withdrawal. If the service has not yet commenced, you may withdraw within 14 days by contacting us.
• Irish consumers (Consumer Rights Act 2022): You have a 14-day right of withdrawal under Irish law. By confirming your signup, you request that we begin providing the service immediately and acknowledge that you lose your right of withdrawal upon commencement of the service.

To request a refund, use our contact form with your name and phone number. We respond within 2 business days.

5. WhatsApp Messaging (GDPR + PECR)

By checking the WhatsApp consent box during signup, you agree to receive automated coaching and marketing messages from ForgeBody via WhatsApp.

• Opt-out: Reply STOP to any message to unsubscribe. You will receive one confirmation, then no further messages.
• Help: Reply HELP for support contact information.
• Frequency: 1-3 messages per day (daily check-in + coaching replies).
• Consent withdrawal: You may withdraw WhatsApp consent at any time. Withdrawal does not affect the lawfulness of prior processing.
• Health data: Separate GDPR Art.9 consent is required for processing your weight and wellness data.

6. Medical Disclaimer

ForgeBody is a wellness coaching tool, not a medical service. The AI coach:

• Does not provide medical advice, diagnosis, or treatment
• Does not replace consultation with a licensed physician, dietitian, or other healthcare professional
• Does not prescribe medications or recommend supplements for medical conditions
• May not be suitable if you have a medical condition affecting diet or exercise

Results vary. Weight loss depends on many individual factors including diet, activity level, health status, and consistency. We make no guarantee of specific results.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer or abuse the AI system
• Share your account with others
• Provide false information during signup
• Use the Service if you are under 18

We reserve the right to suspend or terminate accounts that violate these Terms without refund.

8. Intellectual Property

All content, branding, and software associated with ForgeBody is owned by us or our licensors. You may not copy, reproduce, or redistribute any part of the Service without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, ForgeBody shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: personal injury, health outcomes, loss of data, or loss of revenue.

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold ForgeBody harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Service.

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via WhatsApp or email at least 7 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. For Irish residents, Irish law applies. Any disputes shall be resolved in the courts of England and Wales, or the courts of the Republic of Ireland for Irish residents. Nothing in these Terms affects your statutory consumer rights under UK or Irish law.
